Lawyer up brother. Stop everything else, until you speak to a lawyer. If you just want to put it behind you, then let them repair and let go of it all. Fight the fight right or let it go. Otherwise you will end up filled with irritation and hate about the entire experience. Fight or let it go. Don't do it halfway, without the advice of a lawyer you will be at halfway and forced to fight without good solid ground to stand on.

That right there is the way to go. Get some avice frim a lawyer then make your mind up and go with it.

twlhunter, pm me the name of the dealership (or town). I live just a few towns east of you and I sure as hell don't want to do business with these clowns. fyi, I've had good luck up in Dover. I hope they make this right! :doh:

like what was said above...You have a complicated case. Your safety was compromised. Your faith in Ford was compromised. Your truck is screwed and they have an obligation to "MAKE YOU WHOLE"...

You actually have a great case and the media will back you up if it comes to that and the mere mentioning of the word lawsuit should scare the crap out of them...
GET A LAWYER.


 
Sorry to hear the news. Glad no one was hurt. While it is only a vehicle I feel your
Pain. I think a lawyer and media coverage is the best way to go. Disgrace and a lawsuit is not what they are wanting to deal with. They will settle out of court and you will get what u deserve.

Ford and Lincoln dealerships are private businesses that are independently owned and operated. While we are unable to intervene directly in their policies and practices, we have the capacity to document and forward such complaints electronically to their Customer Relations Manager. They would need to review it for further consideration.

If you have not already done so, I would recommend that you also provide feedback to the Management Team at the Dealership. I believe they would also appreciate knowing the details of your experience.

This is Ford's reply to the insident,I thought they would have more involvement than this!
 
That's what I thought too, Fords allowing this dealership to do warranty work. With substandard service being preformed on Fords vehicles.
They should have more involvment then just sayin' sorry.
I would put more pressure on customer relations.........Let them review it and get all the fact's. Maybe you'll get some back-up. One would hope........

I'm willing to bet that you have a "Mandatory Arbitration" clause buried somewhere in the fine print of your contract with the dealership/Ford which, upon your signing of the contract, binds you from bringing legal action against the dealer for any reason. Instead your complaint will be heard/judged on by a "independant arbitrator" of the dealer's/Ford's choosing. Needless to say the odds are not stacked in your favour.
However, that's not to say that they won't repair the damage...they will. But as far as getting anything else out of them, like a new truck....that will be up to the dealer and their sense of goodwill towards a customer.

Hope it all works out for you.
 
Hiring a lawyer should be your last resort. Just another mouth to feed, and they are all very hungry........

This guy has an expensive problem. Theres lotsa lawyers who will hear him out for free and advise him. Its true that if they have to work, they will charge but thats what experts in any field, law, construction, plumbing etc. do...

his safety was jeopardized. imagine if this fell off at freeway speed and he or another driver in some other car was injured. the mandatory arbitration, if its in the contract is still likely able to be gone around.

FORD and its dealer dont give a shiz about you. They care about your reputation and their money. You need an expert to advise you. nobody here has a real idea of what this will involve.

Today I called my insurance agent, an adjuster is going to the dealership to have a look. The service manager called today and said it's fixed.They did the following,new wheel, tire, rotor, backing plate, studs, lug nuts,plastic shock guard,shock bolt.As far as the shock mount that draged down the road they said the body shop sanded it and painted it like new lol. They also removed the diferential cover and checked it out and said all looked good.So they still owe me for the service charge and whatever loss of value comes to with carfax.The insurance agent said the dealer is the one who figures out the depretiation of the resale value. That does not sit well with me. I hope I get something extra for this bullshit.
 
Your insurance is incorrect. The person that figures out depreciated value is an adjuster. One from your insurance company and one from your side (someone you hire yourself if you wish). You can hire one for a few hundred bucks to get the right amount from your insurance company because the insurance's adjudter will always low ball. Always. Also, you can go somewhere like carmax and ask how much they'd pay for it how it is now and how much they'd pay for it if it didn't have the wreck.

So now you have a lower shock mount thats been drug down the road and ground on? LOL is right...I would defiantly be concerned about that!!!!!
That sounds like it is ready to fail from all the way over here. I don't even have to see it..
Look to see how close the shock bolt hole is to the end of the mount. Compare it to the other side...Then tell them you want a new housing when you see the hole is at the very end of the bracket now..
Please try and take a pic. of this for us to see...
I just stopped typing and went out there and looked at mine.....HELL NO!!!!!!
If that rearend went down the road riding on that bracket for any length of time it is screwed...DON't let them tell you any different and don't take your truck..
I understand that the brunt was probably on the disk and backing plate but still....If that bracket is ground down it will fail...PERIOD!!!!!
Just my rant sorry trying to help...I need a Valum now

I totaly agree with both of you,The rotor did take most of the damage,but when I skided onto the shoulder the shock mount was resting on the concrete curb and the rotor was off the ground.He said they replaced the shock bolt and plastic shock guard so it must be banged up pretty bad. I cant remember,is the shock mount welded on the axel or bolted on around it? If its welded thats probably why they but a band aid on it. Thankfully the 35" tires kept the rest of the bottom from geting destroyed.
